All forms of ordering and acceptance of goods shall constitute consent to the following:

Order Placement & Order Acceptance

ONLINE PURCHASES: If you wish to purchase products from Durable Greenhouse & Nursery Equipment LLC, you may purchase select products offered for online purchasing at www.durablegrowingequipment.com with Visa, MasterCard, American Express, and Discover. Live shipping tables are accessed through our secure shopping cart for exact shipping costs and are clearly added as "shipping" charges during checkout. Any applicable State and City sales tax (applies only to orders originating in Arizona that are not tax-exempt; all other orders will not be charged tax) will be clearly added as "taxes" during the checkout process. Equipment available for online ordering through our SSL secure website includes all control thermostats, all propagating heat mats/seed starting mats, all kits for seed propagation, the model SST-5-120 soil sterilizer, and all items under "Supplies." These items ship by FedEx Ground. For all other equipment not listed here, please contact us directly. We will make every effort to expedite your order. We appreciate your business.

OFFLINE PURCHASES: All products listed on our website, www.durablegrowingequipment.com, can also be purchased offline. All propagating chambers and soil sterilizers must be purchased offline. We accept Visa, MasterCard, American Express, Discover, or Checks (US banks only) mailed to the address listed on our "Contact" page.

For all online and offline purchases, the lead-time is the estimated shipping date at the time of purchase and is subject to change.

All offline purchases must first be assigned an "EZ shipping quote." Quotes are obtained by calling us or by communicating through our online EMAIL form on our Contact page. We can give you a verbal or written quote, whatever is more convenient for you. Please note quotes are subject to change as carriers adjust their rates and per MSRP base price increases.

All offline purchases can then be made by any of the following methods:

  1. Phone us with your credit card information.
  2. Mail us a Check (US Banks only) to the address listed on our "Contact" page.

We reserve the right to decline/refuse any order, online or offline, with or without accompanying payment, until it has been approved by an authorized representative of Durable Greenhouse & Nursery Equipment LLC.

As soon as products are shipped, the customer will receive a confirmation email (or phone call if the customer prefers) which includes the shipment tracking number or freight tracking number if we have it available.

Prices

All prices are in USD and are subject to change without notice. All orders will be invoiced at the prices in effect at the time of shipment.

Taxes

We are required to collect State and City Sales Tax from orders originating in the state of Arizona, U.S.A.

Sales tax exemptions will be allowed only if you qualify and have a signed Tax Exemption Certificate (Arizona Form 5000) on file with us.

Shipping/Delivery

All Pro-Grow orders are shipped to FOB shipping point Phoenix, USA factory via FedEx Ground or Freight Truck, depending on the size, weight, or other restrictions. All Durable Cedar Products are shipped to FOB shipping point Arizona, USA factory via FedEx or Truck, depending on the size, weight, or other restrictions. All other items are shipped to FOB shipping point Arizona, USA, via FedEx, UPS, or USPS.

Where do we ship to? We ship to the 48 contiguous states in the U.S.A., plus Alaska and Hawaii, for most items. We ship to commercial and residential addresses. Please contact us for specifics.

We are not responsible for delayed shipping delivery due to conditions beyond our control.

Our responsibility ceases when merchandise is accepted by the carrier. Carriers are fully responsible for the safe handling and safekeeping of the goods when they are in their possession.

In the event of lost or damaged merchandise, the purchaser must file a claim with the carrier immediately and consult the carrier's claims policies/procedures.

Carefully inspect your goods before signing:

All merchandise must be unpacked and inspected immediately, and if damaged, a claim must be filed with the carrier.

The person signing should read the delivery receipt carefully and determine if the box(es) and product(s) are in visibly good condition. The recipient must make all notations of shortages or damages directly on the delivery/carrier's receipt on all copies, with the driver present to initial the notations. File all claims immediately.

Extra Charges

Trucking companies have extra charges for all types of special services, such as residential delivery, inside delivery, COD, appointment scheduling, lift-gate deliveries, etc., etc. If these services are required, we will be glad to arrange them at your cost. If freight delivery address requires additional charges not estimated/known at time of freight quote, purchaser will be billed for these add-ons.

Terms of Payment

Payment, in accordance with "Order Placement & Order Acceptance," should accompany all orders unless other arrangements have been approved by Durable Greenhouse & Nursery Equipment LLC.

All invoices (other than for payment by check) shall be governed by the credit terms currently in effect. Your acceptance of merchandise shall constitute your approval of these terms. NET 10 DAYS on invoices mean payment is due 10 calendar days from the "Date Shipped" on the invoice.

There will be a $35 charge for all checks returned for whatever reason.

Return of Merchandise

All returns or cancellations must be received in writing and have approval by an authorized representative of Durable Greenhouse & Nursery Equipment LLC. A Return Authorization Number is required for all returns by emailing us at info@durablegrowingequipment.com

If orders have not been shipped, they may be canceled.

If a defective material claim is made, the item must be returned to the manufacturer within 14 days of the purchaser's receipt of the merchandise. A refund may be given as an exchange of merchandise only and subject to the manufacturer's warranty, confirmation of defect, and authorization.

Returns are to be shipped prepaid directly to the manufacturer, and the return freight cost is the sole responsibility of the purchaser. If a replacement is warranted, the shipping of the replacement will not be the responsibility of the purchaser. We will provide you with the shipping address when we assign you a Return Authorization Number.

All items are subject to the manufacturer's warranty and return policies.

Warranty

If any item is warranted by the manufacturer, the purchaser shall look solely to the manufacturer for redress under warranty. Durable Greenhouse & Nursery Equipment LLC shall not be liable for damages or loss of any kind from the use, handling, or storage of goods rendered. For our Pro-Grow Propagation Mats & Pro-Grow Control Thermostats purchases: warranty is void if Pro-Grow Propagation Mats (models PM9A, PM4, PM2) are not used with Pro-Grow Control Thermostats (models GC1, GC2, GC4).

Claims and Seller's Liability

All claims for alleged shortages shall be deemed waived unless made in writing to Durable Greenhouse & Nursery Equipment LLC within 10 days of receipt of merchandise by the purchaser. If a defective material claim is made, the purchaser shall look solely to the manufacturer for redress under warranty. Purchaser shall afford the manufacturer prompt and reasonable opportunity to inspect alleged defective goods. The manufacturer's liability shall be limited to their Warranty policy and to the replacement of any defective goods, which in no event shall include the purchaser's costs, lost sales, profits, or goodwill, or any other special or consequential damages/losses. For all online and offline purchases, the lead-time is the estimated shipping date at the time of purchase and is subject to change.

Suggestions

All suggestions or recommendations are compiled from our research from recognized horticulture sources and manufacturers. We are not responsible for damage or failure because of the recommendations.

Privacy Policy

All information collected to process all transactions, online and offline, will be kept strictly confidential and used only where necessary for the purposes of processing the transaction and fulfilling the order. If the purchaser joins our e-mail list, the purchaser's email address/name and any other information associated with this will be kept strictly private. It will never be sold, shared, or given away for any reason.
